These Terms of Service (the “Terms”) set out the rules for using the Westhaven website and buying products from us. Please read them carefully. By using our site or placing an order, you agree to these Terms. Nothing in these Terms affects your statutory rights under UK law (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013).


1) Who we are

“Westhaven”, “we”, “us”, or “our” refers to the operator of the website westhaven.uk and the seller of goods offered on it. You can contact us at support@westhaven.uk. If you need a registered business address or company number on your invoices/policies, please contact us and we’ll include it on your order paperwork.


2) Using our website

  • You must be at least 18 or have permission from a parent/guardian to use the site and place orders.

  • You agree not to misuse the site (e.g., introduce malware, bypass security, scrape content, or use automated tools in a way that burdens the service).

  • We may suspend or terminate access where we reasonably believe there is fraud, misuse, or breach of these Terms.


3) Account security

If you create an account, keep your login details confidential and let us know immediately if you suspect unauthorised use. You are responsible for all activities under your account unless we are at fault.


4) Products, pricing & availability

  • Product images and colours aim to be accurate, but display settings may vary. Measurements and fit guides are approximate.

  • Prices are shown in GBP and include UK VAT where applicable. Delivery fees are shown at checkout.

  • We may change prices or correct errors at any time. If there is a pricing or availability error after you order, we may cancel the order and refund you in full.


5) Orders & contract formation

  • After you place an order, you’ll receive an order confirmation email. This acknowledges we received your order; it is not acceptance.

  • A contract forms when we dispatch the goods and send a dispatch confirmation. If we can’t accept an order (e.g., out of stock, address issues, failed checks), we’ll cancel and refund you.

  • We reserve the right to limit quantities per customer and to refuse or cancel orders where we suspect fraud or abuse.


6) Payment

We accept the payment methods shown at checkout (e.g., Visa, MasterCard, American Express, Apple Pay/Google Pay, PayPal). Payment is taken at checkout or on dispatch depending on the method. You authorise us to charge your chosen method for the order total, including taxes, delivery, and any optional services you select (e.g., prepaid return label—see Returns). We do not store full card numbers; payments are processed by PCI‑compliant providers.


7) Promotions & discount codes

Promotions are subject to the posted terms and time limits. We may withdraw or amend a promotion at any time where allowed by law. One code per order unless stated; promotions cannot be used on previous purchases or redeemed for cash.


8) Shipping & delivery

Delivery options, timeframes and fees are set out in our Shipping Policy. Delivery times are estimates and may be affected by factors outside our control (e.g., carrier delays). Risk of loss passes on delivery to the address you provide.


9) Cancellations, returns & refunds

Your rights and our process are set out in our Returns & Refunds Policy. Key points:

  • Distance selling (UK): You can cancel within 14 days of delivery. After notifying us, you have 14 days to return.

  • Change‑of‑mind returns: customer pays return postage. You may use any tracked carrier, or choose our optional prepaid Royal Mail label at cost (the amount is deducted from your refund).

  • Faulty/incorrect items: we cover return shipping and provide a full refund or replacement.

  • Refunds are made to the original payment method within 14 days of receiving the return or proof of posting (whichever is earlier).
    Nothing here limits your statutory rights.


10) Reviews & user content

If you submit reviews, photos or other content (“User Content”):

  • You grant us a non‑exclusive, royalty‑free, worldwide licence to use, reproduce, adapt and display that content in connection with our store and marketing (including on social media), and to sub‑license service providers for those purposes.

  • You promise your content is your own, accurate, and not illegal or harmful, and that it does not infringe others’ rights.

  • We may moderate, edit or remove User Content at our discretion where it breaches these Terms or applicable laws.


11) Intellectual property

All content on the site (text, graphics, logos, photos, video, code) is owned by us or our licensors and protected by IP laws. You may use the site for personal, non‑commercial use only. Any other use requires our prior written consent.


12) Third‑party services & links

Our site may contain links to third‑party sites or use third‑party services (e.g., payment processors, couriers). We’re not responsible for their content or privacy practices. Your use of those services may be subject to their terms.


13) Limitation of liability

We’re responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. We do not exclude or limit liability where it would be unlawful to do so, including for death/personal injury caused by negligence, fraud, or for breach of your statutory rights.

We are not liable for losses that are not foreseeable, for business losses, loss of profit, loss of data, or for events outside our reasonable control.


14) Events outside our control

We’re not responsible for delays or failure to perform caused by events outside our reasonable control (e.g., strikes, carrier issues, extreme weather, pandemics). We’ll do our best to minimise any impact and keep you informed.


15) Suspension/termination

We may suspend or end your access if you materially breach these Terms, misuse the site, or if we are required to by law. You can close your account at any time by contacting us.


16) Complaints & disputes

If you have a complaint, email support@westhaven.uk and we’ll try to resolve it quickly. If we cannot resolve a dispute, these Terms and any purchases are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction. Consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.


17) Changes to these Terms

We may update these Terms from time to time. We’ll post changes on this page and update the “Last updated” date. Changes apply to orders placed after the updated Terms are posted.
